General conditions of sale of the Limonadier store

ARTICLE 1 - SCOPE OF APPLICATION AND ENFORCEABILITY

1.1 These general terms and conditions of sale apply in their entirety and constitute the conditions of all offers and sales from the online store: Limonadier.co - The products offered by the company Fournier Whisky to any consumer customer, of legal age on the date of purchase on the site or emancipated minor or providing proof of authorization signed by their legal representative, residing in mainland France, on the Limonadier.co site

You can view the Terms and Conditions at any time on the website by clicking on the "Terms and Conditions" tab at the bottom of the homepage. The applicable Terms and Conditions are those in effect at the time of your order.

ARTICLE 2 – ORDERING PRODUCTS

2.1 Creation of a Customer account

To order products, you must have a customer account. Complete the form in the "Create an account" section, fill in the required fields, and validate. Once registration is complete, a confirmation email with an activation link will be sent to you.

2.2 Product Selection

Browse product categories and add the desired items to your cart by selecting the quantities. For any questions, contact us by email.

2.3 Price of Products

Prices displayed include all taxes. Delivery costs are mentioned when selecting your delivery method.

2.4 Viewing the basket

View selected items in your shopping cart. You can change quantities or delete items before finalizing your order.

2.5 Choice of delivery method

Deliveries are made by DHL, La Poste, Colissimo, FedEx, UPS, DPD, or Cocolis in mainland France, Corsica, and the French overseas territories. In case of absence, a calling card will be left for collection at a post office.

2.6 Validation of your order

Accept the T&Cs, read the Privacy Policy, then click on “Order with payment obligation” to confirm.

2.7 Payment for your order

Payments are secure and made through a PCI-DSS certified service provider.

2.8 Confirmation of the order

A summary email will be sent to you after validation of your order.

ARTICLE 3 – RIGHT OF WITHDRAWAL

3.2 Terms of exercise

You have 14 days to withdraw. Send the withdrawal form by email to contact@limonadier.fr or by mail to: Benjamin Fournier, 10 rue de l'Hôtel de Ville, 26000 Valence.

3.3 Return of Products

Returns must be made within 14 days of your cancellation. Return shipping costs are your responsibility.

3.4 Reimbursement

Refund will be made within 30 days after receipt of returned items.

ARTICLE 4 – OPPOSITION TO TELEPHONE CANVASING

ARTICLE 5 – LEGAL GUARANTEES APPLICABLE TO PRODUCTS

The Seller is liable for defects in conformity of the Product to the contract under the conditions of Article L.217-4 et seq. of the Consumer Code and for hidden defects in the item sold under the conditions provided for in Articles 1641 et seq. of the Civil Code.

When acting under the legal guarantee of conformity, the consumer:

- has a period of two years from delivery of the goods to take action;

- may choose between repair and replacement of the goods, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code;

- is exempt from providing proof of the existence of the lack of conformity of the goods during the twenty-four months following delivery of the goods.

The consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In this case, the consumer may choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

ARTICLE 6 – PERSONAL DATA

When you browse the Site or order Products on the Site, we collect personal data about you. This data is used under the conditions set out in our Privacy Policy, which we invite you to read.

ARTICLE 7 – CLAIMS AND DISPUTE SETTLEMENT

7.1 The T&Cs are governed by French law.

In the event of a dispute, you have the option of using a conventional mediation procedure free of charge.

To use this mediation procedure, you must first send your complaint to Fournier Whisky by registered letter with acknowledgment of receipt. If you do not receive a satisfactory response within one month, you may contact the mediator according to the terms and conditions provided by the latter on its website.

This mediation is optional, confidential and free, with the exception of any legal or expert fees which will remain your responsibility.

The dispute cannot be examined by the mediator when:

- you do not provide proof of having previously attempted to resolve your dispute directly with Fournier Whisky by means of a written complaint;

- the request is manifestly unfounded or abusive,

- the dispute has previously been examined or is being examined by another mediator or by a court,

- you submitted your request to the mediator more than one year after your written complaint to the company: Fournier Whisky

- the dispute does not fall within the mediator's jurisdiction.

If the outcome of the mediation does not suit you or if you do not wish to resort to a mediation process, you can refer the matter, at your choice, to the competent courts within the jurisdiction of the registered office of Fournier Whisky or to the competent courts within the jurisdiction of your domicile.
